Terms and Conditions

Contract
The contract shall consist only of our offer and your acceptance of the Survey and Order Form and these terms, nothing else shall form part of the contract and be binding on either you or us. It is our responsibility to supply you with goods that meet your consumer rights. Nothing in this contract affects your statutory rights.

Warranty
All our Stairlifts are supplied with 12 months warranty which applies from the date the Stairlift is installed. This covers the parts and labour for faulty manufacture or installation. It does not cover faults caused by you or other people. This warranty is not insurance backed.

Power
A 13 Amp plug socket or fused spur must be provided, this will be discussed on the survey. If one is required one will need fitted before installation. Bronte Stairlifts Ltd will not carry out the work.

Installation
We will try our best to keep to the agreed installation date, but we cannot guarantee them to reasons outside our reasonable control. You are not entitled to claim damages if we cannot meet the install on the date provided.

You will not own the Stairlift until the full balance is collected. Until that time, we may take back the Stairlift at any time.

Liability
We accept full responsibility for any death or personal injury which may be caused (a) as a result of our negligence; (b) by any breach of our obligation under this contract; and/or (c) as a result of any other act or omission on our part. We will not be liable for any changes or modifications made to the Stairlift without our knowledge.

Safety
If for any reason the installer deems the lift unfit for purpose, we will be entitled to cancel your order, even if it has already been accepted. We will return any deposit you have already paid us as soon as possible. If this is the case, we provide a full written explanation of why this is the case.

Loss and Damages
If you suffer any loss or damages we are responsible for then you must allow us reasonable opportunity to remedy the problem, we will not be responsible for any loss or damage which you fail to allow us a reasonable opportunity to put things right.

Removal of Old Lifts
We will endeavour to remove it as carefully and cleanly as possible, there may be residual damage as a result of this.

Buying Back
When the Stairlift is no longer needed, depending on the condition and age of the lift, we may buy the lift back. The price will depend on how long the Stairlift has been installed. We reserve the right to refuse to buy the Stairlift back, depending on location and stock levels. The least we will offer is a free removal service.

Payment
The payment is due on installation of the Stairlift on satisfactory completion of the job. We accept Cash/Card/Debit and Credit Card / Bacs.

Complaints
Where we cannot resolve any complaints using our own complaints procedure, as a Which? Trusted trader we use Dispute Resolution Ombudsman for dispute resolution. In the unlikely event of a complaint arising and you wish to refer the complaint to them please contact 0333 241 3209 or via their website.

The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013

Notice of the Right To Cancel.
Under the above regulations, you have a right to cancel this contract during a period of 14 calendar days from the day this notice is sent or given to you. During that period if you choose to cancel the contract any money paid by you will be refunded.

However, if you have already given written approval for the work to begin before the end of the cancellation period you may be required to pay for goods or services already provided.

If you wish to cancel the contract you must do so in writing and deliver personally or send (which may be by electronic mail or post) this to the person named below. You may use the form below if you want to but you do not have to.

The notice of cancellation is deemed to be served as soon as it is posted or in the case of an electronic communication from the day it is sent.

If you cancel this contract, we will collect the lift at our expense, we will make the reimbursement without delay and no later than 14 days after we have received the goods we supplied back from you.

We will refund you in the same means the original payment was made unless agreed otherwise, or if you have paid us in cash.

You are only liable for any diminished value of the goods from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

You will not be reimbursed or recompensed for any alterations that may have been made to the staircase or surrounding area nor for any holes in the carpet/floor caused by the installation and subsequent removal of the stairlift.

If you decide to cancel within fourteen working days, you may be asked to pay for any work that has been done prior to my cancellation.
